Tender Clarifications

Q: Concerning on the above statement listed in the "Invitation to the Bid Letter", can you please provide further details on how this will be executed? In what form of the 5% of the contract value will be submitted to MIMOS and when will be this value return to bidder?
A:

Please be informed that your company is required to deposit a Performance Bond in the form of an irrevocable bank guarantee from a bank established in Malaysia in the amount of Ringgit Malaysia: being five percent (5%) of the total contract value, with MIMOS within fourteen (14) days from the date Letter of Acceptance (LOA). The format of the Performance Bond will be attached together with the LOA once you are being awarded for the contract. This Performance Bond should be valid until end of warranty period.

Q: Under the scope of work document, item 1.5.1 – "Bidder MUST use the draft agreement provided by (MIMOS) as the contract document for this provision. " Is it possible to send me a copy of the draft agreement?
A:

The agreement will be forwarded/attached together with the LOA once you are being awarded for the contract.

Q:

Will there be any bid briefing / site visit during this MCO period? If yes, when is it schedule?

A:

There is no briefing session for this provision.

Q: A hard copy of the bidding document is it required to hand into MIMOS?
A: As we are now observing Movement Control Order (MCO) and working from home, all competitive bidding exercise will be conducted via email/online. You may submit your proposals/documents in pdf format in a compressed file with password through dedicated email at procurement.info@mimos.my.
Q: 1.4.2 Kindly send me the specific safety requirements and interpretation of standards for my review.
A: Please refer the guideline based on IEC61010-1 Safety requirements for electrical equipment for measurement, control and laboratory use (as attached).
Q: 1.6.1 Must I submit the spare parts list together with the tender submission or later? This is because the English version spare parts list for the equipment may not be made available from the manufacturer before the tender closing date.
A: You may submit the Japanese version first. Please make sure the English version is send within one week after the tender close. Take note that this is Mandatory requirement.
Q: 1.7.1 Must I submit the details of the preventive maintenance together with the tender submission? This is because the English version service manual for the equipment may not be available from the manufacturer before the tender closing date.
A: Please list the necessary preventive maintenance such as valve, temperature and rotation driver. English version of service manual for the equipment need to provide within 1 month prior to agreed date of delivery or no later than three (3) months after the date of issuance of Purchase Order (See 1.3.4, Other Requirement in Scoop of Work document).
Q: 1.2.3 Must I submit calibration/reference standard or consumables during tender submission or during installation and commissioning?
A: Please provide calibration/standard and consumable during installation & commissioning.
Q:

What is payment term that apply on MIMOS?

A:

(i) 100% of the total Contract Price to be paid to the contractor upon the successful delivery and full acceptance of the system by MIMOS as provided for under the Acceptance Criteria. Payment shall be subject always to the full completion of contract documentation.

(ii) MIMOS’ payment term is 30 days after receipt of the Contractor’s complete and undisputed invoice/claim, attached with a copy of the LOA, the approved delivery order (D.O.) note and/or approved certificate of completion on the services/works (the fulfilment of the Acceptance Criteria) and relevant supporting document.

Q:

1.4.3 Must I submit the warranty letter from the manufacturer on availability of spare parts for a period of 5 years together with the tender submission or during installation and commissioning?  This is because the equipment manufacturer is from Japan which was having their Golden Week holidays from April 29th to May 6th.

A:

Understand the delay response due to Covid-19 and Japan holiday period. As for now, you may submit formal email conversation between Japan manufacturer regarding this term. Then submit the warranty letter within one (1) week after the tender close. Take note that this is Mandatory requirement.

Q: 1.1.3 Must I provide the local and overseas installed bases information with tender submission? This is because I have to consult our principal.
A: Yes
Q: 1.2 Industrial reference – Must I provide all the 3 information from 1.2.1 to 1.2.3 during tender submission as I have to consult our principal.
A:

It is a General requirement not a must, however, any information provided by vendor will be used by technical team to evaluate and give a score. Higher score means more preference.

Q : Is it possible to share a details or highlights those important terms and condition that might state in the agreement?

A : Please be informed that the MIMOS’ Contract Document details only can be shared to the successful bidder but not at this juncture.

Q : What is common payment term that apply on MIMOS ?

Q :  Is it the submission tender is still remain as online only since the MCO is partially lifted now?

A : As for now, please submit the document to procurement.info@mimos.my. If any changes, we will update the information in our website.

Q :  How to submit a complete tender with the required supporting documents during this MCO period?

  2. It is mandatory for bidders to attend the bid briefing or site visit unless stated otherwise.
  3. One bidder can only represent one company during the briefing and site visit.
  4. The bidding payment/ participation fee must be made through on-line banking with appropriate reference or via cash deposit machine to MIMOS MAYBANK Account Number 512147020249 and the proof of payment must be attached with the bid proposal. The participation fee will not be refunded.
